If you have a loved one who suffered at the hands of a negligent nursing home, you might be wondering how much compensation you stand to receive. It is a fair question. After all, you need to know whether it is even worth it to file a lawsuit in the first place. Secondly, you need to plan your financial future. You might be struggling to pay medical bills your elderly family member left you with after passing away. So, how much do you stand to receive?

If you would like to receive an accurate estimate, your best bet is to get in touch with an elder law attorney in New Jersey. During your initial consultation, you can explain your unique situation. Your attorney can then provide you with legal advice and may be able to give you a rough estimate regarding your potential settlement. It is best to book a consultation as soon as possible for best results.

New Jersey Nursing Homes are Constantly Being Sued

The first thing you need to know is that nursing homes in New Jersey are constantly being sued. These lawsuits are not seen as “out of the ordinary,” and you stand a good chance of success based on the outcomes of previous cases. On May 6th, it was reported that a nursing home was being sued in New Jersey in relation to COVID-19 deaths, with plaintiffs also pointing the finger at the state government.

Governor Phil Murphy and Health Commissioner were named in the lawsuit as defendants, and they were accused of violating nursing home patients’ civil rights. The plaintiffs are the families of two elderly women who died in private nursing homes during the pandemic. Just five months prior, the state agreed to pay a total of $53 million to settle claims made by family members of deceased nursing home patients throughout the state.

According to the lawsuit, the state ignored warnings that its strategy of “containing” the COVID-19 virus within nursing homes was going to end in the loss of human life. This is of course related to Murphy’s now-infamous “Order 103.”

Murphy has responded by calling the entire debacle a “tragedy within a tragedy” while promising to find out what exactly went wrong with the state’s approach. Many other states are facing similar controversies, and Massachusetts just agreed to pay out $56 million to the families of deceased nursing home residents. This equates to about $400,000 for each family, and this should provide you with some idea of how much your settlement might be worth.
